Regulatory Update on Compensation
With the publication in the Official Journal of Legislative Decree No. 73 of 21 May 2025, new binding provisions concerning freight transport have come into force. These measures aim to safeguard operational efficiency and ensure compliance with contractual deadlines in logistics supply chain relationships:
1. Compensation for Loading/Unloading Stops Beyond the Allowance
The legislation introduces a mandatory framework for the management of waiting times at loading and unloading sites:
A 90-minute allowance is established for each operation, calculated from the time of the vehicle’s arrival at the designated location.
After this period, a compensation of €100 is due for each hour or fraction of an hour of waiting, payable jointly by the client and the loader.
This amount will be automatically adjusted annually according to the ISTAT FOI index.
The compensation claim may be formalized within the time limits set by Article 2951 of the Civil Code, including by way of an injunction.
It is important to emphasize that road transport is inevitably exposed to various unforeseen events (traffic, accidents, weather conditions, local regulations), which cannot always be predicted or mitigated in advance. These circumstances call for a collaborative and flexible approach in managing operational schedules.
2. Payment Terms for Transport Services
The legislation also reinforces compliance with payment deadlines:
- Pursuant to Legislative Decree 231/2002, the maximum term is 60 days, unless otherwise agreed upon for justified reasons.
- In the event of systematic delays or abusive contractual clauses, the Competition and Market Authority (AGCM) may intervene either ex officio or upon notification to impose warnings or sanctions (Article 83-bis of Legislative Decree 112/2008, as amended).

- Organize loading and unloading operations punctually, to maintain efficiency and minimize additional costs;
- Ensure timely payment in line with contractual and legal deadlines.
